摘要
实践中开发商通常在商品房买卖合同中约定在确定的日期内将"经验收合格"并符合本合同约定的商品房交付给买受人使用。那么何谓"经验收合格",其法定标准是什么?对此法律并未作出明确规定,这样就使得开发商、买受人,甚至法院在适用有关法律时具有随意性。文章通过对现行法律规定的分析,认为合同当中的"经验收合格"应为取得《工程竣工验收报告》并通过规划部门、环保部门的验收,房屋交付法定条件为"准竣工验收备案表"标准,并建议对延期办理房产证实行按日累积违约金来促使开发商积极办证,倡导"低法定、严约定"的交房思想。
Real estate enterprises and consumers generally agree in the sale contract of commodity house that the delivery of commodity house to the buyer within the date should be on the condition of being qualified, but what is qualified and what is the legal standard ? The law does not make it clear, which makes the real estate enterprises, the buyer, even the justice confused and leads to arbitrary in the law application. This article believes, through the analysis of the stipulations of current law, a qualified commodity house required in the contract should achieve the project completion acceptance report and the acceptance of the planning department and the environmental protection department, and the legal delivery condition should be quasi completion acceptance. And the paper suggests implementing daily accumulated liquidated Property, and advocates "lower legal standard, damage for the delay of handling the Certificate of House bigger damage sum" in the delivery of commodity house.
