摘要
仅局限于完善政府采购制度本身还不足以解决政府采购中存在的一系列问题,加强其外围配套制度的建设也至关重要。预算是影响政府采购实施的上层限制环节,预算制度的不完善导致政府采购的漏洞难以避免;行政问责机制是拷问政府采购主体责任的事后环节,要把握行政责任的确定、行政责任的追究和行政问责的救济三个运行基石;监管体系是规制政府采购运行的上层控制环节,统一协调、权责清晰的监管体系有利于防止政府采购超出合法、合理界限;政府采购的电子化、信息公开和公众参与,可以强化政府采购的透明度,从而弥补监管漏洞。
That the efforts of improving government procurement supervision are confined to the government procurement system itself is insufficient to solving a number of problems in this field. The accompanying measures should also be taken. The imperfect budget system makes government procurement easily vulnerable since budget is the pre-supervision element affecting government procurement while administrative accountability that includes the three steps: determining administrative responsibility, holding tully accountable, relief of administrative accountability is the post-supervision element investigating the responsibility of the subject of government procurement. As the upstream control link of government procurement, a united and harmonious regulatory system with clear responsibilities can ensure that government procurement is legal and reasonable. In addition, E-commerce, information openness, public participation and administrative transparency can also remedy supervision holes.
