The Legal Application of the Crime of Illegal Business Operations——Based on the Practical Analysis of Hunan Provincial Public Security Economic Investigation Department

非法经营案已成为目前经济犯罪防控、打击的重点。近年来湖南省公安机关打击非法经营犯罪活动取得了系列成效,但由于其罪名的不确定性,公安机关在具体实践中仍频频面临困境。针对当前公安机关打击非法经营类犯罪所存在的问题,应采取适当的措施予以解决和规制。

Illegal business case has become the focus of the prevention and control against the current economic crime. However, because of the uncertainty of its charges, the public security organs have been troubled in practice. Based on the practice of Hunan provincial public security economic investigation, this thesis has a deep-going interpretation of the connotation and extension of the crime of illegal business operations, and comprehensive analysis of the current public security organ for illegal business crime problem, and the author puts forward suggestions to step up efforts and improving measures to combat the crime of illegal business.
