摘要
《劳动合同法修正案》有些条款没有抓住劳务派遣规制的要害,不可能根本解决问题。要想使劳务派遣回归理性渠道,必须着力改变劳务派遣用工比直接用工成本低、标准劳动关系中刚性有余弹性不足的状况,适当抬高劳务派遣用工的成本,进行国企机关事业单位用工制度改革,改革过于刚性的用工体制。具体实施路径包括严格贯彻同工同酬原则;完善税收、社保等体制;建立人员能进能出、岗位能上能下的劳动力资源市场配置机制和人力资源管理机制等。
Since some clauses of the Amendment to Labor Contract Law do not go to the point of regulating labor dispatch,it can not resolve the problems completely.In order to realize rational labor dispatch,the situations such as lower labor costs of labor dispatch,rigidity of normal labor relations must be changed.It is necessary to have an appropriate increase of labor costs of labor dispatch,to reform of employment system of SOEs and government departments and institutions and to reform the inelastic employment system.
