摘要
在住宅专项维修资金纠纷解决法律机制中,业主和业主委员会、房地产行政主管部门和物业公司都是合格的诉讼主体,诉讼请求区分为作为和不其他请求两大类别。根据目前相关法律规定,建立了相应的民事、行政和刑事法律责任制度。住宅维修资金纠纷解决法律机制对于维护资金的安全及有效使用具有重大作用。
In the legal mechanism for the special maintenance fund disputes, the owner, the owner committee, the administrative department and the property company are qualified subjects of litigation. And the claim consists of action and omission. Based on the present related laws, the corresponding civil, administrative and criminal legal responsibility systems have been built. So the mechanism has great func- tion in keeping security and effective use of the fund.
