机动车商业第三者责任险中多车肇事连带责任问题研究

《侵权责任法》的颁布实施使得一般侵权连带责任的适用范围有所变小,因此多车肇事时连带责任的认定也呈现严格趋势。我国现行《机动车商业保险行业条款》第23条并未将连带责任置于承保范围之内,这一条款约定既不宜于被保险人转移保险风险,也未对事故受害人构成完善保障,同时也不符合其他国家和地区保险行业的基本惯例,应当予以删除。

The promulgation and implementation of the Tort Law narrows the applicable scope of the general tort li- ability. Hence, it tends to be stricter for the liability identification of multi-vehicle accident. In China, Article 23 of Clauses for Automobile Commercial Insurance Industry doesn＇t include joint and several liability into the scope of coverage. As a result, it neither helps the insured to transfer the insurance risks, nor provides complete security to victims. Moreover,it doesn＇ t comply with fundamental practices of the insurance industry in other countries or re- gions. Therefore, this Article should be removed from the provision.
