土地利用规划地方分权化法律制度探析

我国现行土地利用规划制度由中央政府单一供给,导致规划的决策中心化,地方政府的利益诉求长期被漠视。在土地利用规划权日趋地方化的背景下,为了维护地方土地利用规划合理的自主权,中央政府应当在维护规划法制统一化的前提下,确认地方政府土地利用规划决策的主体地位,加强中央和地方互动,完善中央与地方规划权力的动态配置,以规范、整合地方的利益诉求。

Our current system of land use planning is only designed by the central government, resulting in centralized planning decision-making and local government interests being ignored for a long time. Under the background of increasing localization in land use planning power abroad, the central government in China should gradually devolve power of land use planning to maintain the local autonomy of land use planning power. Under the premise of unification of legal system, the central government should recognize the local government＇s the position as participator in the land use decisions. The legal system should also strengthen the democratic interaction process between the central and local government, improving the dynamic configuration of the central and the local planning power. In this way can local interest demand be normalized and integrated.
