浅析媒体对医患纠纷报道的法律规制

Analysis on the Legal Regulating of the Media Coverage on Medical Disputes

媒体对医患纠纷的报道起到了监督医疗机构、普及医学知识、提高公众医学素养、弘扬医学人文精神、构建和谐医患关系的作用。随着网络技术的飞速发展,加之医疗卫生体制不完善、医疗信息不对称等诸多因素的影响,有些媒体对个别医患纠纷案件的报道背离了案件的客观事实,甚至参杂着媒体人的主观偏好,出现了诸如新闻审判、隐性采访过度、新闻来源失实、媒体诽谤等问题。鉴此,为引导媒体正确报道医患纠纷,构建和谐医患关系,必须要处理好司法审判与民意的关系。本文在重点考察媒体报道医患纠纷的现状及其消极影响的基础上,对媒体报道医患纠纷失实的原因进行了分析,并结合国内外医疗报道的理念及法制建设的经验,对我国媒体报道医患纠纷时应遵循的相关法律法规提出了建议。

Media coverage on medical disputes plays the roles such as supervising medical institutions, popularizing medical knowledge, improving public medical literacy, promoting medical humanistic spirit, and developing a harmonious doctor-patient relationship, etc.. With the rapid development of network technology, combined with some other factors such as the imperfection of healthcare system and the asymmetry of medical information, etc., some media coverage of individual doctor-patient disputes deviated from the objective facts of the case, even was mixed with media people＇s subjective preference, therefore, the following problems arose： trial by news, excessively recessive interview, untrue news source, and media defamation. Consequently, it is necessary to correctly handle the relationship between justice and public opinions with the purpose of correct media coverage on doctor-patient disputes and the construction of a harmonious doctor-patient relationship. Based on the studies on the current situation and its negative influence of media coverage of medical disputes, this paper analyzes the reasons for false media coverage of doctor-patient disputes, and puts forward some suggestions for media coverage of doctor-patient disputes in China combined with the concept of medical coverage and the experiences of legal system construction at home and abroad.
