制度视角下的边民跨国婚姻研究——以云南德宏州为例

A Study of Cross-National Marriage between the Border Residents in the Institutional Perspective:Taking Dehong Yunnan for a Case Study

边民跨国婚姻的产生除了宏观社会环境因素之外,还与边境地区长久以来形成的特殊场域——跨疆界传统小社会及其内部孕育的民族宗教文化等非正式制度紧密相关。国家为履行社会控制职能而制定的跨国婚姻相关法规,是从控制跨境人口流动和保护入境通婚人员权益的角度进行的制度设计,在一定程度上实现了国家对跨国婚姻的有序管理,然而非正式制度影响下的跨国婚姻行为选择与正式制度社会控制职能之间难以弥合的张力,使得边民跨国婚姻面临一定的制度困境。

The emergence of transnational marriage between the border residents is closely related not only with the macro - social environmental factors, but also with a special field formed through a long period of time in the border areas - cross - border small societies and informal systems such as the ethnic religions and cultures created in those areas. The national regulations for transnational marriages made by the state government are produced for social control - the control of cross - border population mobility and the protection of the interests of immigrated cross -married couples. To a certain extent, the rules have helped the country maintain the cross - border marriages in good order. However, due to the tension resulting from the cross - national marriages influenced by informal customs and formal regulations based on institution, the cross - national marriages will encounter certain institutional difficulties.
