我国环境侵权损害救济制度完善思考

Improvement of Approaches to Remedy and Compensation for Infringed Damages of Environment in China

从保护受害人合法权益的角度来看,我国目前环境侵权责任制度无法实现环境公平正义。要使环境侵权损害赔偿得以真正实现,必须构建综合救济途径。在制度建设上,主要是完善侵权责任法中的环境侵权排除危害责任制度与商业保险法中的环境责任保险制度。

From the perspective of protecting the legitimate rights and interests of victims, the current environmental tort liability system cannot fair and square for environmental issues. To realize the compensation for infringed damage of the environment in China, we must build up a comprehensive relief strategy. In the construction of such systems, four are chiefly needed to improve, that is, the system to eliminate the hazards of environmental liability in tort liability act, the system to enhance environmental liability insurance in commercial insurance, the environmental and social indemnity in social insurance system, and the administrative compensation for environmental tort in administrative law.
