论行政诉讼调解制度建立的可能性

On the Possible Establishment of Mediation System for Administrative Litigation

目前我国行政诉讼中没有调解制度,笔者通过对我国与域外行政诉讼调解理论与实践方面现状的考察,然后对行政诉讼调解制度建立与否的争论分析后,表明赞成建立行政诉讼调解制度,最终提出我国行政诉讼调解制度在理论与现实基础方面建立的可能性。

At present, there is no meditation system in the administrative litigation of our country. Through an inspection about the theory and practice of administrative litigation mediation at home and a- broad, this article analyses and argues for the possible establishment of the system in our country and e- ventually points out the theoretical and practical basis for its establishment.
