摘要
信访制度的异化是我国从人治向法治转变过程中产生的问题,是由于人治思想的深刻影响和现有权利救济制度的缺陷所导致的。从历史角度和现实角度分析信访制度的定位,可以得出信访制度异化的结论。信访制度异化所带来的弊端成为推动信访制度改革的动力。化解信访制度异化需要立足法治,具体分析废除论、强化论、改革论的主张,可得出结论:改革信访制度,矫正信访功能是化解信访制度异化的理性归宿。
The alienation of the petition system, arising in the transformation lrom the 14ule of Man to me of Law, is caused by the defect of right remedy mechanisms and deeply affected by the remaining of the thought of the Rule of Man. With the analysis on the orientation of such system from both historical and realistic perspectives, it is concluded that the alienation of such system exists, which leads to the reform in the relevant field. It is impor tant that the reform should be carried out from the perspective of the Rule of Law. Considering the different theories, the rational solution concerning the issue is to adjust the function of such system.
