帮助毁灭、伪造证据刑事责任的司法界分与立法完善

The Judicial Branch and Legislative Perfection of Criminal Responsibility of Helping to Destroy or Falsify Evidence

我国在行为主体、法益评价、刑罚配置等方面对帮助毁灭、伪造证据刑事责任作了立法切分。司法工作人员犯帮助毁灭、伪造证据罪从重处罚,不应以利用职务便利为必要条件。司法工作人员实施帮助毁灭、伪造证据行为构成徇私枉法罪,不应以利用具体职务便利为限。司法工作人员、辩护人、诉讼代理人、一般人员共同实施帮助毁灭、伪造证据行为的,可以根据罪刑相适应原则和共同犯罪原理,分为5种情形区别处理。未来立法在凸显对辩护人、诉讼代理人、司法工作人员从严处罚之刑事政策基础上,应当弱化一般人员与辩护人、诉讼代理人、司法工作人员实施帮助毁灭、伪造证据行为的责任差异。

In our country, the criminal responsibility of helping to destroy or falsify evidence is seg-mented in aspects of behavior subject, benefit evaluation and penalty configuration. The judicial staff who offends the crime of helping to destroy or falsify evidence shall be given a heavier punishment,who offends the crime of helping to destroy or falsify evidence shall be given a heavier punishment, but not be used his position to facilitate the conditions. The judicial staff who offends the crime of tak- ing bribes in order to turn a verdict in somebody＇ s favor by helping to destroy or falsify evidence should not be limited by specific job convenience. According to the principle of suiting punishment to crime and joint crime theory, the judicial staff, the defender, agent, the general staff who help to de- stroy or falsify evidence together can be divided into five kinds of situations differently. Based on the highlighting the criminal policy of strict punishment for the defender, agent and the judicial staff, the difference of the criminal responsibility of helping to destroy or falsify evidence should be weakened in future legislation between the defender, agent and the judicial staff.
