我国转基因食品损害赔偿法律问题

On the Chinese Legal Issues of Compensation of Genetically Modified Food Damage

目前,转基因食品损害赔偿问题是转基因食品安全管理法律体系中最为重要而又最为薄弱的环节之一。为了构建我国转基因食品的损害赔偿制度,结合损害赔偿问题在国际层面的最新发展,提出在建立赔偿制度时应注意几个问题:关于损害的界定和损坏赔偿的范围;损害赔偿主体机制;损害赔偿责任标准的确定;财务保障机制的建立;因果关系的确定等。

The issue of compensation of genetically modified food damage is one of the most and the most weak issues in the legal system of safety management. In order to build up the compensation system in China, according to the latest development in the international level of this issue, several problems should be paid attention to：the definition and the scope of damage;subject of liability and compen- sation; standard of liability ; mechanisms of financial security; causation.
