Mergence of the Legal Positivism and the Natural Law Theory——Taking the Institutional Theory of Law as an Example

现代法律实证主义理论认为法律实证主义与自然法的二元对立并没有揭示任何重要的真理。现代法律实证主义已经放弃了传统法律实证主义的拒绝价值、拒绝正义的僵硬立场,而是选择了接受现代自然法的合理因素。制度法律理论是现代法律实证主义理论的一种。这一理论对现代自然法观念的接受从法律实证主义这一方面体现了当代自然法和实证法的融合的趋势。

Modern legal positivism no longer regards the separation of the legal positivism and the natural law theory as necessary .A case in point is the institutional theory of law w hich accepts the reasonable el-ements of the natural law theory .With this theory ,we can see the trend of mergence of the legal positiv-ism and the natural law theory .
