我国公司犯罪的现状、原因及对策

Current Situations,Causes and Countermeasures of Company Crimes in China

在我国,公司犯罪是单位犯罪和经济犯罪交集的一部分,对于公司犯罪我国《刑法》做出了相关规定。但目前对于公司犯罪现象﹑产生原因及治理对策研究尚未引起足够的重视。由于公司犯罪在内的经济犯罪黑数大,企业家犯罪与公司犯罪密切相关,仅通过专项行动治标不治本。笔者主张在对公司犯罪进行分类的基础上,探求公司犯罪背后复杂多样的原因,建立健全制度机制,推进和完善法治,才能有效治理公司犯罪。

Company Crimes which provided by criminal law are part of intersection of unit crimes and economic crimes. However, current situations, causes and countermeasures of compa- ny crimes have not brought enough attention. Because of the dark figure of economic crimes which including company crimes is enormous, and entrepreneur crimes are closely related to com- pany crimes, using specific projects are palliative. Based on the classification, author explores the complicated causes of company crimes, perfect institutional mechanisms, and promote rule of law, so that we can govern company crimes effectively.
