摘要
在保障民生和推进新型城镇化建设背景下,保障房用地法治化建设无论在观念上还是在实践中都面临着诸多亟待解决的问题。为促进我国保障房用地法治化建设,必须要树立公平兼效率的土地法理念,坚持保障房用地优先性、独立性原则,创新土地法律制度,即将保障房用地规划与计划制度化、扩充非经营性用地的地类、构建多元化的保障房用地开发主体、建立独立的保障房用地土地储备制度、赋予各方利益主体用地规划的参与权。
In the context of promoting people's livelihood and promoting new urbanization, there are many issues on legal construction of affordable housing land both in concept and in practice. , The concept of balancing fairness with efficiency should be set up. The law should adhere to priority of providing affordable housing principle and independence principle. Legal system innovation should be strengthened, such as innovating and expanding current legal system of public welfare land, enhancing diversification of affordable housing reserve system, entitling the interested party to participating decision making power in land -use planning .
