福建省建筑业企业资质管理的调查研究

The Research of the qualification management to construction enterprises in Fujian Province

我国对建筑业实施的资质管理制度,经过三十年的发展,逐渐暴露出落后于市场现状的诸多问题,存废之争愈演愈烈。通过对福建省及其他部分省市的实地调研,并借鉴国外建筑业管理方式进行综合分析后,笔者建议在建筑业中完善行政处罚,并引入国际贸易纠纷解决方式、公益诉讼、累犯等制度,与我国建筑业具体问题相结合,逐步解决建筑业痼疾,供建设主管部门参考。

Through 30 years, the qualification management for construction industry in China exposed many problems in arrears of market gradually. The con- troversy between retention and abolition become even more violent. Through the field research in Fujian province and several other provinces and the reference of several mode of foreign construction management, the author suggests to perfect the administrative punishment in the construction industry, and to introduce the solution of dispute in international trade, the public interest litigation and recidivism system, to solve the problems of construction qualification management for the department in charge of construction reference.
