Development Situation,Characteristics and Policy Suggestions for China's Network Legislation

完善的网络立法是保障网络的正常有序运行与维护网民正当权利的前提。从1994年国务院颁布第一部网络法规至今,我国网络立法工作得到了很大的发展,已经基本上覆盖了各个领域。但与网络技术的快速发展和司法实践的实际要求相比,我国网络立法仍存在着立法层次低、法律法规相冲突等诸多问题,完善网络立法势在必行。为此,文章通过对现阶段我国网络立法发展状况的总结,分析了其内在特点和立法实践中存在的问题与不足,提出了进一步完善网络立法的政策建议。

The perfect network legislation is to protect the normal and orderly operation of the network. Since the State Council issued the first network regulations in 1994, China＇ s network legislature has been greatly developed. Network legislatures have basically covered all areas. However, compared with the actual requirements of the rapid development of network technology and judicial practice, there are still many problems, such as low level of legislation, conflicts be- tween laws and regulations. Therefore, this paper summarizes the current development of network legislation in China, analyzes its inherent characteristics and existing problems, and proposes policy recommendations to improve the network legislation.
