我国农业行政处罚裁量基准问题探析

Analysis on the discretion standard of administrative penalty in agriculture in China

农业行政处罚裁量基准制度存在基准定性不准确、制定程序不规范、制定基准的质量不高等问题。通过对这些问题进行深入的理论分析,提出明确基准性质,规范基准制定程序,加强指导和交流,减少不合理差别等对策建议,以期提高农业行政机关依法行政和制度建设水平、规范农业行政执法。

There are some problems such as discretion inaccuracy, procedural irregularity and poor quality in enacting discretion standard in the discretion standard system of administrative penalty in agriculture. According to in-depth theoretical analysis on those problems, it is proposed to confirm the essence of standards, regulate the standard-targeted procedures, strengthen the instruction and communication and decrease unreasonable discrimination, so as to improve the legal enforcement and institution construction of administration in agriculture, and standardize administration and law enforcement in agriculture.
