摘要
西北少数民族交易习惯,形成于西北少数民族数千年的生产生活中,具有悠久的历史渊源和鲜明的地域特征,是我国重要的习惯法。西北地区回族和新疆少数民族的交易习惯,体现出本土法律与外来法律相互交融、浓厚的宗教色彩、表现形式上的不成文性等特征,能够鼓励商品贸易、促进商品经济快速发展,规范合同行为、维护良好的交易秩序,是西北少数民族人民的生产生活,特别是商品交易的重要的法律渊源。但是,西北少数民族交易习惯在司法适用中面临如何与国家法之间协调一致、如何在具体案件中适用交易习惯及司法审判人员轻视民族交易习惯等问题。
As one of the most important Chinese customary laws, the trading habits of the minorities in Northwest China, formed in the life process in thousands of years, has a long history and distinctive regional feature. The trading habits of the Hui in Northwest China and the minorities in Xinjiang are characterized by the blending of native laws and foreign laws, religious features and their unwritten forms. As important law resource for the life and production of the minorities, particularly tradesmen in the areas, such trading habits can promote commodity trades, the rapid development of commodity economy, the standard contract behaviors and the maintenance of a good trade order. However, consid- erations should be paid to these trading habits in terms of their coordination with state laws, the reason- able application of such habits as well as the avoidance of the habits in judicial practices and so on.
