摘要
中国房地产业宏观调控从未达到控制房价快速上涨的预期效果,因此应转变调控思路,研究建立房地产调控的长效机制。本文在检讨历次房地产调控手段失灵原因的基础上,提出长效机制的本质是制度改革。长效机制和法律有着内在的联系,在长效机制的建立过程中,法律应该起到重要作用。同时,探讨了如何建立房地产调控长效机制的具体法律路径。
Macro - control of real estate in China has never achieved its target, so long - term macro - control mechanism should be set up. This paper examines the causes of failure and proposes that long - term mechanism is the reform of system. Long - term mechanism and law have inner connection, and law should play its role in the construction of this mechanism. In the meantime, the legal approach to how to set up a long- term mechanism is discussed.
