摘要
首先分析了以民营快递为主的网购物流在实践中存在的典型问题,如先签字后验收、快件损毁、丢失、快递慢投等;然后提出不能机械地套用《合同法》等现有法律法规来进行责任认定,而应该在分析网购各相关主体间相互法律关系的基础上,对网购物流方应承担的法律责任予以厘清;最后得出网购物流应承担的法律责任,即确保消费者"先验货后签字"的权利;承担物流过程中快件丢失、损毁的赔偿责任以及承担快件延误的赔偿责任等。
In this paper, we first analyzed the typical problems in the practice of the on-line shopping logistics as represented by privately operated express delivery, then pointed out that the liability attribution in the process should not follow available laws and regulations mechanically such as the Contract Law but instead be based on an analysis of the legal interrelationship between the agents in the on-line shopping, and at the end, we proposed the legal responsibility liable for the logistics service providers.
