信访制度作为中国特有的一项制度,有其深刻的现实基础、社会背景和历史渊源,在政治参与、权力监督、权利救济等方面发挥着重要作用。但中国现行信访制度是一把双刃剑,由于存在着诸如法定救济途径被虚置化、考核评价体系不科学等制度性缺陷,影响了作用的发挥,也造成了某种程度的混乱,对法治形成了一定冲击。对信访进行改革应沿着正确的发展趋向,回归本位,立足国情,依托法治,注重实效,并坚持"五有信访"路径,稳步推进。

As a unique system in China, the Public Voice System has played a much realistic, social and historical role in such as po- litical participation, power supervision, right remedy. The current system in China, however, has become a double-bladed sword due to its inadequacy in legal right remedy, unreasonable evaluation index, etc. , which has deteriorated its functions, caused disorder and negatively affected the rule of law. The reform of the system should move in the right direction to revive its basic functions based on the reality of this country, the rule of law and the true effectiveness while sticking to the Five Principles of Public Voice System.
