Construction of Legal Protection Mechanism for Tender Activities in State-owned Enterprise

国有企业招标活动涉及众多法律主体、操作程序繁琐,存在多层法律风险。本文通过分析当前国有企业招标领域存在的问题,以"发现问题,解决问题"为目的,从法律顾问参与招标活动,提供法律保障的视角,重点介绍招标准备阶段和开标、评标、定标阶段法律保障工作机制构建的内容,以期通过必要的法律保障手段,规避法律风险,更好地实现国有企业招标活动的公开、公平、公正和诚实信用原则。

Tender activities in state-owned enterprise are filled with multileveled legal risks because of numerous legal subjects involved and complex operating procedures.This article intends to introduce construction of legal protection mechanism for tender activities in state-owned enterprise, which includes tender preparation,bid opening,bid evaluation and selection through the analysis of problems in state-owned enterprise from the perspective of the counselor who involved and provides legal protection in tender activities. With purpose of avoiding legal risks and achieving better principle of public,fair,impartial and honesty and credit, necessary legal protection means will be recommended in this article.
