摘要
劳动教养制度作为一项颇有争议的制度,其存废又成为媒体关注的焦点问题。改革劳教制度,是必然要作出的历史选择。刑罚、行政处罚的衔接全面实现公法责任,劳动教养在我国的责任体系中根本就没有存在的余地。建议把现有的劳教事由分流处理,有步骤地把劳教事由逐渐纳入到刑法、治安管理处罚法和其他行政法等部门法中,以实现劳教制度的顺利废除。
As a controversial system, reeducation though labor system shoud be abolished or not has become the focus of media. It is an inevitable selection to reform the system of reeducation though labor. The coordination of the criminal punishment and administrative penalty realizes the public responsibility comprehensively, so re- education though labor doesn' t exit in the law responsibility system in China. So the reason of the reeducation though labor can be handled to bring into other law departments so as to abolish the reeducation though labor successfully and promote integrity and development of the whole legal system.
