摘要
大学章程制定试点工作启动至今,我国已有六所高校的章程获得教育部核准。通过分析六所大学章程的具体内容,发现我国大学章程的制定依然面临着章程法律效力得不到保障、章程内容具有趋同性、内部管理沿袭原有体制、高校办学自主权在章程中得不到彰显、对章程内容的落实缺乏有效监督等困境。走出这些困境的出路是,应该以立法的形式核准大学章程,提升大学章程的法律效力;加快取消高校行政级别的步伐,进一步理顺政府与高校的关系;推动大学共同治理,促进章程监督机制的建立。
Since the launch of the pilot program of university statute formulation, statutes of six Chinese universities have been approved by the Ministry of Education. Based on a text analysis of six university statutes, the article reveals the dilemma in the formulation of university statute from the following perspectives: the legal effect of university statute cannot be guaranteed; the contents of statute for different universities tend to be similar; university's internal management follows the original system; university autonomy is not highlighted in the statutes; there is a lack of an effective supervision system for the implementation. Policy recommendations for the solution of the aforementioned dilemma are also provided in the article.
