论农地入股企业的产权配置——以农地功能及其价值构成为视角

农地价值包括质量价值、社会保障价值、社会稳定价值、生态价值和发展价值等,入股企业按照支付的价值不同而享有不同的权利,并免除相应的义务。农地入股实质是农地产权的重新配置,是以农地产权中的某种权利或权利束入股,入股企业按照取得的不同权利束来支付入股对价。农地入股流转是经济法权利与经济法义务的流转,是国家为规范农业经济的发展,从社会整体利益最大化的宗旨出发,协调利益相关者对入股农地的利益。农地入股的性质应该是一种受国家监管的经济调制行为。农地入股企业终止时,入股农民可支付相应的成本依法取回农地,使流入企业的农地权利束回归入股农民,农地产权重归完整。
