论体育裁判自由裁量权的滥用及其监控

体育裁判自由裁量权在现代体育比赛中被滥用的情况大量存在。以体育裁判自由裁量权的特征为出发点,讨论了体育裁判自由裁量权滥用的判断标准及其表现形式。为防其被滥用,通过对滥用原因的分析,提出了监控体育裁判自由裁量权的方法:第一方监督,即裁判的道德自律;第二方监督,是立法机构、体育行政机构、体育协会、体育俱乐部、新闻媒体乃至运动员、公民个人构成对体育裁判自由裁量权的第二方监督;第三方监督,即对体育裁判自由裁量权的司法审查。

On the basis of competition judge＇s discretion characteristics, We discuss on the judgment standard and the manifestation of the competition judge＇s dis- eretion abused in this article. In order to guard against competition judge＇s discretion to be abused, Through the analysis of abuse＇s reasons, We co - me up with three ways to control the competition judge＇s discretion： The first party supervision is competition judge＇s moral self - discipline ;The second party supervision is the legislature, sports a - dministration, sports as- sociations, sports clubs, news media ,athletes and individual citizens who control competition judge＇s discretion ;The third party supervision is Judicial review of competition judge＇s discretion
