论当代中国的法治文化概念

Contemporary Chinese Cultural Concept of the Rule of Law

本文试图在当代中国的法治文化研究中区分出三种类型的法治文化概念,它们分别是作为领域或对象的法治文化概念,作为方法的法治文化概念,强调法治文化整体意蕴的法治文化概念,分别对应三种文化概念,即为强调外延的文化概念,作为意义之网的文化概念和作为一种整体生活方式的文化概念。三种类型的法治文化概念也是三种典型的研究进路,本文试做简单述评。

This paper attempts to distinguish three types of cultural concepts of rule of law in contemporary China, which are the cultural concept as a field or object, the cultural concept as an approach, and the cultural concept emphasizing the cultural implication. The three types of concepts are also three types of typical research approaches.
