摘要
软法是相对于传统硬法而言的,是指不依赖于国家强制力保障实施的,但又具有实际约束力的行为规范。软法之治的核心就是如何发挥其"实际约束力"。软法主要包括国家软法和社会软法。《就业促进法》中之所以存在大量的软法规范,主要是因为就业政策等软法规范长期在我国就业促进方面的推动作用,以及就业权及其立法保障的特殊性。《就业促进法》的有效实施必须依靠其中软法规范的有效实施。可通过增强政府的公信力,创新政府责任形式,完善责任追究方式等软法实施机制来保证。
Relative to conventional hard law,soft law is not dependent on guaranteeing the implementation by national mandatory,but the code of conduct with actual binding.The core of the rule of soft law is how to play 'the actual binding'.Soft law mainly includes national soft law and social soft law.There are a large number of soft laws in'Employment Promotion Law',mainly because of the motivation of employment policy and other soft law in China employment promotion,as well as the employment right and its legislative safeguard particularity.Effective implementation of'Employment Promotion Law'must rely on the effective implementation of soft law which is guaranteed by enhancing government's credibility,innovating government liability form,improve accountability and soft law implementation mechanism.
