论少数民族文化旅游资源集体产权的法律保护

On the Legal Protection of the Collective Property Right to Cultural Tourism Resources of a National Minority

少数民族文化旅游资源集体产权是指权利主体对少数民族社区内的文化旅游资源所享有的支配和收益的权利。我国有关法律对少数民族文化旅游资源集体产权作了间接的规定。但是一些法规否定少数民族群众集体对社区内的文化旅游资源拥有产权。因此,应当对我国有关法律进行修改,确立少数民族文化旅游资源集体产权制度,对少数民族文化旅游资源集体产权实行民主管理。

The collective property right to cultural tourism resources of a national minority means that the owner has the right to control and yield from the cultural tourism resources in a national minority community. The related Chinese laws indirectly regulate that a national minority enjoys the collective property right to cultural tourism resources. However, some laws and regulations deny that. Therefore, the related laws should be perfected by regulating definitely that a national minority is the owner of the cultural tourism resources in their community, and establishing the system that a national minority enjoys the right to manage democratically the cultural tourism resources in their community.
