Establishing the Institutional Channel to Unify the Rights Claim and Stability Maintenance

摘要 一个开放、公正和充满活力的社会秩序是中国持续繁荣和长治久安的基础。当前维护社会稳定具有长期的意义。将群体性行动释放出的能量转化为实质性的公民参与,已成为"维稳"模式转变的关键点。维稳与维权在逻辑上具有统一的可能,这就是把"事后的抗争行为"转化为"事前的积极参与行为"。影响这个转变的关键因素是地方决策过程的转型。当下的重大决策之社会稳定风险评估机制旨在把维权系统与维稳系统两者统一起来。以推进社会稳定风险评估机制为契机,推动地方公共决策从相对封闭的、以领导(个体或集体)偏好为主的决策方式转向一个开放、多元、包容和协商的决策过程,这是建构维权与维稳统一的制度通道的关键。因此,重大决策之社会稳定风险评估机制具有推进决策过程转型的潜在功用。 Today it is of long-term significance to maintain social stability as an open, vigorous and impartial social order provides a solid foundation for China's sustained prosperity and peace. The key point of shifting the stability maintenance pattern lies in the transformation of the energy released from the collective action to the civic participation. Rights claim and stability maintenance are possible to be unified in logical sense in that the resistance action afterwards is supposed to be transferred into the active participation beforehand. The key factor is the transition of the local policy-making process. The current risk assessment mechanism of social stability concerning the major policy-making is intended for achieving the unity of the two. Taking the mechanism promotion as an opportunity, efforts are made to propel the local public policy-making process from a relatively-closed leaders (individual/group) - preference-oriented pattern to an open, tolerant, consultative and pluralistic one, which is the crux of establishing the institutional channel to unify the rights claim and stability maintenance. Therefore, it can be concluded that the promotion of the risk assessment mechanism of social stability concerning the major policy-making functions as a way to potentially advance the transition of policy-making process.
