论技术标准专利权滥用行为的法律规制——兼评华为与交互数字集团案

The Combination of Technical Standard and Patent: Problems and Countermeasures——Comments on Case between Huawei and Inter Digital Group

作为知识产权运用的一种新手段,技术标准与专利权的结合在专利技术产业化和抢占国际市场竞争制高点等方面具有重要作用,但随之而来的是专利权人价格歧视、违反信息披露义务、联合抵制、专利联营等专利权滥用行为从而导致大量的法律纠纷。技术标准专利权滥用行为产生的根本原因在于专利权人经济利益的驱使、专利行政管理机关的默许以及法律规范的相对滞后,亟需从标准化管理体制机制以及相关法律完善两方面提出应对之策。

As a new way to use intellectual property right, the combination of technical standard and patent plays an impor- tant role during market competition, while it may also result in price discrimination, violation of information disclosure ob- ligation, boycott and pooling arrangements etc. The reasons for abuse of patent contain pursuing economic interests, con- nivancy of patent administrative organ and the lag of legal norms, which need to be resolved by improving the technical standard management system and amending relevant law.
