论放弃继承权的效力

On Validity of Renunciation of Succession

放弃继承权,是指继承人于继承开始后、遗产分割前所作出的放弃继承被继承人遗产权利的意思表示。我国现有继承法对放弃继承权的有关规定过于抽象和原则,实务中缺乏可操作性。为完善我国放弃继承制度,本文探讨了放弃继承的溯及效力、附条件或附期限放弃继承权的效力、继承人放弃继承后应继份额的处理及放弃继承权撤销的效力,分析了我国现行放弃继承制度存在的缺陷,从立法体例和内容上提出了完善我国放弃继承权制度的立法建议。

Renunciation of Succession means the heritor gives up inheriting the heritage rights after the opening and before the segmentation of the inheritance .China ’ s current provisions concerning renunciation of the law of succession are abstract and too principle in practice maneuverability .Therefore , this paper proposes to improve the legislative style and content of the system of renunciation of succession by first discussing the retroactivity, condition and period of validity of renunciation , the procession of the renunciated share and the revocation validity , and then analyzing the defects of the current system of inheritance renunciation .
