协商民主视阈下我国环境公众参与制度的疏失与更新

The Defect and Innovation of Public Participation in Environmental Protection System from the Perspective of Deliberative Democracy

我国的环境法律体系初步规定了环境公众参与制度,但既有立法存在专门性不强、规范零散未成体系、程序规定不足以及可操作性不强等诸多弊端。学界既有研究的弊端检讨与完善建议流于就事论事,未从保障民主实现的价值目标出发,具体建议难以见容于当前制度体系,理想化大于现实操作性。

The environmental statutory framework of our country preliminarily established the environ-mental public participation system.But the framework also has the following shortages：weak expert-ness;the fragment of standard not forming a system;the insufficient procedure stipulation;weak feasi-bility and other shortages.Moreover,not only the framework does not stand on the value aim of the re-alization of guaranteeing democracy,but also the specific suggestions can not be easily embodied to the present system.Besides,the idealism of the framework overstates the feasibility with the merge of the shortages of study and the perfect of suggestion.
