南海自由贸易区的功能创新与法律保障

Function Innovation and Legal Guarantee of the Free Trade Area of the South China Sea

随着海南洋浦保税区、海南国际旅游岛的创设和三沙市的设立,围绕海南经济特区构建南海自由贸易区,已经具备了地理、人员、法律法规的基本条件。如何设计南海自贸区的基本内容,实现其功能在现有基础上的突破与创新,是一项亟待解决且意义重大的问题。我们从特别关税区、原油综合贸易平台、离岸金融中心、国际旅游自由岛等自贸区的功能创新入手,在分析其内涵与重要意义的同时,进一步提出积极的政策应对与法律保障,以期为我国南海的经济发展提供有益之借鉴。

With the establishment of Yangpu Bonded Zone,Hainan international tourism island and Sansha City,everything,ranging from geographic location and personnel to the laws and regulations,proves to be favorable in the construction of Hainan Special Economic Zone Free Trade Area. It is quite urgent and important to design the basic of the free bonded area so as to achieve a breakthrough in and an innovation of its present function. Beginning with the function innovation of the free trade area special tariff zone,comprehensive oil-trade platform,offshore financial center and international tourist island,this paper then puts forward the ways in which favorable policies work with active protection from laws,so as to provide useful reference for the economic development of the south China sea region.
