论湄公河流域执法安全合作机制建设与中国应对

The Construction of Mekong River Basin Law Enforcement and Security Cooperation Mechanism and China＇s Response

湄公河案件发生之后，中老缅泰四国举行了湄公河执法安全合作会议，先后通过了《湄公河流域执法安全合作会议纪要》和《中老缅泰湄公河联合巡逻执法部长级会议联合声明》两份重要的国际文件，正式提出建立湄公河流域执法安全合作机制。然而，这两份国际法律文件无论在各国的权利义务的分配，还是机构设置方面都没有详尽的规定。中国应采取相应措施促进湄公河流域执法安全合作机制的建设和完善。

After the Mekong murder cases, China , Laos, Myanmar and Thailand held the law enforcement cooperation conference to restore and maintain the safety of navigation on Mekong River. Two important international documents ＂The Mekong River Basin Law Enforcement Security and Cooperation Minutes ＂ and ＂Joint Statement of Law Enforcement Along Mekong Revier＂ have been passed, formally proposing the establishment of the Mekong River Basin enforcement security cooperation mechanism. These two international documents are legally binding international treaties, which laid a direct legal basis for the construction of Mekong law enforcement and security cooperation mechanisms. However, the allocation of rights and obligations, or the institutional settings in the two international legal documents are not prescribed in detail. In addition, due to various reasons, the four countries have not been coordinated with each other, which indicates the law enforcement and security cooperation in the Mekong River Basin will face the predicament. Therefore, the construction of the law enforcement and security cooperation mechanism in the Mekong river is still in its infancy, and there would be quite some distance away from the long-term stable cooperative mechanisms.
