“小产权房”的分类治理策略

Classified Governance Strategies for Limited Property Rights House

我国政府制定了一系列的政策制止"小产权房"建设,但由于这些政策缺乏实质性的整治措施,再加上"小产权房"业态多样、利益关系复杂,"小产权房"的建设势头没有得到有效遏制。本文在剖析"小产权房"产生原因的基础上,提出了"小产权房"治理路径,包括"小产权房"治理的制度建设和现实手段。"小产权房"治理的制度建设主要包括完善农村土地产权制度,构建城乡统一建设用地市场以及相关的配套制度。"小产权房"治理的现实手段采用分类治理的策略:要遵循"明确房屋建设状态、判断是否符合规划、确定占地性质、了解房屋用途"的思路,并针对不同类型治理路径给与差别化的政策供给。

Limited property rights house is not allowed to be constructed and traded according to the existing policies. However, due to the various types of limited property rights house, the complicated vested interests and the lack of concrete measures, so far limited property rights house construction has not been constrained effectively. Based on a detailed analysis of the corresponding reasons, this paper puts forward new classified governance strategies. The making of classified governance strategies include four steps, that is, defining housing construction status, determining whether conformed to the planning requirements, confirming the land use types of the encroached land and investigating the housing uses. Differentiated governance and policies are thus constructed in view of different types of limited property rights house.
