摘要
就民族区域自治地方立法权行使的现状来看,自治区单行条例缺失的现象不容忽视。综合我国现有法律体系的相关内容,并结合单行条例自身的特点,其主要原因至少有以下几个方面:其一,上位法界分不明。其二,上级立法机关监督缺位。其三,立法主体的"理性规避"。其四,立法的直接法律依据缺失。
As for the current situation of national autonomy’ legislative power, the phenomenon of the Vacancy of autonomous region special decree should not be ignored.Combining the characteristics of special decree with the current content of the legal system in our country, the main causes of the Vacancy of autonomous region special decree as follows： Firstly, fuzzy discrimination in higher-level Law; Secondly, the vacancy of the superior legislative supervision; Thirdly, legislators’ “rational evasion ”; Fourthly, the lack of direct legal basis.
