摘要
在我国,作为促进航运业发展的重要险种——保赔险,一直由中国船东互保协会和中国人民保险公司等商业保险公司经营。近年来,境外保赔协会逐渐进入此领域,其市场份额越来越大。但是在保赔险监管中,由于互助经营与商业经营、国内承保与国外承保并存,导致多元监管与监管真空并存、监管内容缺乏针对性等等问题,这些对保赔险发展提出了严峻挑战。在深入分析此种情况的形成原因基础之上,本文认为出台单独的相互保险组织法,赋予中船保相互保险组织的资格;统一监管机构,严格监管规范;加强对境外保赔协会的监管等,是目前亟需解决的问题。
As an important insurance product to promote the development of the shipping industry, protection and indemnity insurance(P&I) has been run by China Ownership Mutual Assurance Association and commercial insurance companies such as PICC in china. In recent years, some overseas mutual underwriting associations gradually entered China' s P&I field and their market shares are expanding. Because of the coexistence of mutual operation and commercial operation, and domestic underwriters and foreign underwriters, there exists such grave problems as the coexistence of regulation diversity and regulation vacuum, and the lack of well-directed measures. These prob- lems are presenting serious challenges for China' s P&I development. In order to promote P&I' s healthy develop- ment, the paper suggested to draw up Mutual Insurance Organization Act, give China Ownerships Mutual Assurance Association the qualification of mutual insurer, unify regulatory bodies, carry out strict supervision, strengthen regula- tion of overseas mutual underwriting associations, etc.
