论认罪态度与死刑的限制适用

On the Application of Confession Attitude and Death Penalty

认罪态度作为重要的量刑情节,对死刑的限制适用具有重要意义。无论是国内还是国外,认罪态度情节都是死刑裁量中应予考虑的重要因素。认罪态度情节限制死刑的适用,应重点从三个方面入手:认罪态度较好的,可酌情从轻处罚,不判处死刑或者死刑立即执行;认罪态度一般的,也可考虑不判处死刑立即执行,特别是可以与其他从宽处罚情节一起共同发挥抑制适用死刑立即执行的作用;一般的认罪态度不好,不应作为适用死刑的积极情节。

Confession attitude as a key sentencing guideline is of importance meanings to restricted applica tion of death penalty. Whether in our state or in foreign countries, confession attitude remains the major factor in death penalty discretion. Application of death is limited by confession attitude, mainly in three aspects： better attitude can win mild punishment, free from or immediate execution of death penalty; normal attitude can also bring non-sentencing immediate death, especially considering other guidelines of mitigating penalty to co-build the function of restricting death penalty ; for bad attitude, the positive guidelines is not available to re striction of death penalty.
