国际飞机租赁的快速、健康发展，有赖于国际飞机租赁立法来保障制订国际飞机租赁的统一实体规范是必要的。从确立国际飞机租赁的两种租赁机制入手，理论上论述了确立飞机租赁当事人权利和义务的原则，国际飞机租赁的抵押担保途径及正确处理租赁飞机的留置权和抵押权等重大法律问题。

 The rapid and healthy development of the international aircraft lease and rental business must be guided by sound international legislation in this regard． The necessity of formulating the uniform substantive rules for the international aircraft lease and rental business is explained． Proceeding from the establishment of the two main mechanisms for such aircraft lease and rental business this paper discusses such major legal issues as the principles for establishing the rights and obligations of the interested parties the approaches to mortgages and guarantees in international aircraft lease and rental and the proper ways of how to handle the lien and mortgage for leased or rented aircraft．
