The Definition of Abuse of Dominant Market Position by the Internet Enterprises

摘要 近年来我国有关互联网企业的一系列反垄断诉讼,特别是360诉QQ滥用市场支配地位的"中国互联网反垄断第一案",表明互联网企业的垄断行为主要集中在滥用市场支配地位上。互联网企业的主要经济特性是网络效应,它决定了反垄断法在正确规制互联网企业的滥用市场支配地位时,照搬界定相关市场和认定市场支配地位的传统方法是不行的,在认定市场支配地位时除了考虑市场份额外还要考虑进入壁垒,在认定滥用市场支配地位的行为时要结合互联网企业的特殊性,运用合理原则本着谨慎的态度予以认定。 In recent years, a series of antitrust lawsuits about Chinese internet companies, especially the case of 360 V. QQ, for its abusing of market dominant position, which was "the first Chinese case of internet an- titrust", indicated that the internet enterprises' monopolistic behaviors mainly focused on the abuse of a domi- nant position. The main economic characteristic of the internet enterprises is network effects. It determines that when the antitrust law regulates the abuse of a dominant position by internet enterprises, the direct copy of the traditional way to define the relevant markets and the market dominance is not suitable. When we define a dominant position, in addition to market share, we should take into account barriers to entry. When we define the abuse of market dominance by the internet enterprises, we should take into account the particularity of the Internet enterprises, should keep a cautious attitude and apply the reasonable principle.
