摘要
"制作录音制品法定许可"的立法目的是防止唱片公司对唱片业的垄断,文章从法定许可的方式、条件、期限、但书条款入手,提出了推进"制作录音制品法定许可"的策略,应建立、健全使用付酬机制,并实现版税分配机制的透明化。
The first draft amendment to the Copyright Law ,which is legally reasonable ,has drastically transformed the legal license for Sound recording .But the second draft changed it under the press of interest groups and industry association.Analysis the argument about legal license for Sound recordings on legislative purpose ,legal approach , conditions,deadline and proviso with the purpose of finding what legal license ought to be ,before the second draft comes out .
