摘要
劳动者的涵义在我国不同的历史时期,因计划经济体制向市场经济体制的转变而不同。计划经济体制下,以"工人"为核心的劳动者理论,仅仅是对其身份的确认,且有浓厚的政治色彩。而市场经济体制下,以劳动合同为纽带的劳动者理论,是对雇主与雇员之间的劳动关系的确认。劳动者涵义的发展,使得原有的具有政治色彩的强势工人身份被淡化,而法律意义上的劳动者的弱势地位得以加强,导致劳动者理论与司法实务的冲突。在司法实务中,要解决大量无书面劳动合同而存在事实劳动关系的问题,事实劳动关系成为劳动者理论的有益补充。我国劳动者理论应以从属劳动理论进行阐述,在制度上完善就业制度、劳动合同制度和劳动程序制度。
The meaning of Chinese workers changes in different historical period due labor theory which has the connection of labor contract is to establish the labor relationship between the employers and the employees. The meaning of development causes the original strong political identity of workers weakened and the weak position of the labors in law strengthened and the conflicts between theory and the judicial practice of workers. In judicial practice, to solve a lot of labor relationship problems concerning no written labor contracts but of factual existence have become beneficial supplement of labor theory of factual labor relationship. The theory of our country should be expressed based on the slave labor theories and perfect employment system, labor contract system and labor system.
