随着我国犯罪态势、刑事政策以及刑事立法的变化,刑罚结构也应进行相应的调整,以充分发挥刑罚效益。根据我国刑法对犯罪的规定模式以及刑罚体系的特点,刑罚改革的重点应该放在轻刑问题上,"整体趋轻、单极发展"是我国刑罚结构改革的应有选择。在"整体趋轻、单极发展"的模式下刑罚结构改革不仅表现在对已有刑罚种类的修改上,也应进行体系性的思考,使刑罚结构体系更加完善,刑罚结构要素更加科学。

With the change of crime situation, criminal policy and criminal legislation of China, penalty structure should be adjusted accordingly in order to give full play to penalty efficiency. According to the patterns of China~ criminal law provisions and the characteristics of penal system, penalty reform should focus on light punishment. ＂penalty tending to light generally and unipolar development＂ should be selected by reform of penalty structure. In the mode of ＂ penalty tending to light generally and unipolar development＂ ,penalty structure reform should not only be reflected in the modification of existing types of penalties, systematic thinking should also be considered, so that the penalty structure system will become more complete and the penalty structure elements will become more scientific.
