“双轨”运行:城镇化进程中农村宅基地(使用权)制度解困的可行解

“Dual-track”Operating: The Feasible Solution of Rural Residence Land's Dilemma under the Background of Urbanization

作为我国土地制度的重要组成部分,农村宅基地(使用权)制度起到了保障农民居住权和维护农村社会稳定的重要作用。但随着城镇化进程的加快,农村宅基地(使用权)制度日渐陷入困境,现有制度安排不仅造成农地资源浪费、导致进城农民权益受损,而且在一定程度还阻碍了我国城乡一体化发展。从我国的现实国情(尤其是从农村的实际情况)来看,构建农村宅基地(使用权)"双轨"运行机制应是破解其制度困境的可行解。

As an important part of our country land system, the rural residence land system safeguards farmers ＇ habitation and maintains the rural social stability. With the speeding up of urbanization process, the rural residence land system is getting stuck in a dilemma, not only causes waste of farmland resource and damage of farmers＇ rights, but also hinders the integration of urban and rural development. From the reality of our country national condition, ＂dual -track＂ operating should be the feasible solu- tion of rural residence land＇ s dilemma.
