我国老年监护制度的法律重审——以《老年人权益保障法》为视角

Law Review about Safeguard and Supervision for the Aged——Based on " Law of The Elderly Rights and Benefits Protection"

民法中规定的成年监护制度只适用于精神病人,对于老龄化社会背景下的老年人监护没有做出明确的规定。老年监护制度是老年人保障体系的重要组成部分。建立老年监护制度,保障其合法权益,是我国民事理论和司法实践迫切解决的现实问题。此次《老年人权益保障法》的修订明确规定了这一制度,是立法的一次进步。为保障该制度的良性运行,需从原则确立、制度设计、措施跟进三方面科学构建完整的老年监护体系。

Adult guardianship only applies to the mental patients in Civil Law, and ifs not applied to senior citizens in the aging society. Safeguard and supervision for the aged is an important part of the elderly security system. To construct safeguard system to ensure the legal rights of the aged is a urgent problem of civil theory and juridical practice. Law of The elderly rights and interests protection is legislative progress, which provides safeguard and supervision for the aged. To scientifically construct an efficient safeguard and supervision system for the aged, principles should be established, systems should be set up and measures should be provided in time.
