摘要
鉴于内地与香港各自法律制度的特点以及两地司法协助的现状,香港民事诉讼机制是目前解决因内地港资企业负责人逃匿而引起的跨境追偿欠薪问题的唯一可行法律制度。根据香港有关法例及判例,香港劳资审裁处对跨境追偿欠薪案件具有司法管辖权。劳资审裁处程序规则可以解决因跨境追偿所引起的诸多诉讼程序困局。香港民事诉讼判决强制执行机制为劳资审裁处所作判决的有效执行提供了丰富的制度资源支持,从而保证通过香港民事诉讼机制跨境追偿欠薪的实效。
In consideration of the difference in feature between China's Mainland and Hong Kong legal system, and the status quo of mutual legal assistance between, the only solution under legal mechanism to back pay resulted from escape of the key person of Hong Kong invested enterprise is civil action in Hong Kong. Pursuant pertinent legislation and precedent, the jurisdiction over cross border back pay recovery litigation belongs to Hong Kong La- bour Tribunal. The procedure rule of Labour Tribunal solves several difficulties in connection with cross border back pay recovery in litigation procedure. Moreover, enforcement of civil judgment in Hong Kong serves as supporting resource to the enforceability of judgment from Labour Tribunal, thus ensuring the feasibility of cross border back pay recovery through civil action in Hong Kong.
